1. ACCEPTANCE OF TERMS

By accessing or using www.kmbur.com (the "Website") and/or placing an order for products or services with Custom T-shirts- Make it your own ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our Website or services.

2. SERVICES DESCRIPTION

We specialize in custom screen-printed and embroidered apparel, including but not limited to:

Custom T-shirts
Hoodies
Sweatpants
Polos
Sweatshirts
Other custom apparel items

We offer fast turnaround times, rush order options, free shipping on all orders within the United States, and high-quality products and designs.

3. ELIGIBILITY

You must be at least 18 years of age to place an order through our Website. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

4. INTELLECTUAL PROPERTY RIGHTS AND DESIGN OWNERSHIP

4.1 Customer Responsibilities

By submitting any design, logo, artwork, text, or other materials ("Customer Materials") to us for printing or embroidering, you represent and warrant that:

You own all rights to the Customer Materials or have obtained all necessary permissions, licenses, and authorizations to use such materials;
The Customer Materials do not infringe upon any copyright, trademark, patent, trade secret, or other intellectual property rights of any third party;
The Customer Materials do not violate any law or regulation;
You have the authority to grant us the right to reproduce the Customer Materials on apparel products.

4.2 Indemnification for IP Infringement

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to any infringement or alleged infringement of intellectual property rights resulting from your Customer Materials.

4.3 Right to Refuse Service

We reserve the right to refuse to print or produce any design that we believe, in our sole discretion, may infringe upon third-party intellectual property rights, violate any law, or contain inappropriate or offensive content.

5. ORDERS AND PRICING

5.1 Order Placement

All orders must be placed through our Website or by contacting us directly. By submitting an order, you are making an offer to purchase products subject to these Terms.

5.2 Order Acceptance

We reserve the right to accept or decline any order in our sole discretion. We will provide confirmation of order acceptance via email. A contract between you and us comes into existence only when we send you confirmation that we have accepted your order.

5.3 Pricing

All prices are listed in United States Dollars (USD) and are subject to change without notice. The price charged will be the price displayed at the time your order is confirmed. Quoted prices are valid for thirty (30) days unless otherwise specified.

5.4 Minimum Orders

Certain products or services may require minimum order quantities. Minimum order requirements will be communicated prior to order confirmation.

6. PAYMENT TERMS

6.1 Payment Methods

We accept major credit cards, debit cards, and other payment methods as indicated on our Website. All orders must be paid in full before production starts unless we agree otherwise in writing.

6.2 Payment Due Date

Payment is due upon order placement unless alternative payment arrangements have been agreed upon in writing. We do not begin production until payment in full has been received.

6.3 Late Payments

If payment is not received when due, we reserve the right to suspend or cancel your order and/or charge interest on overdue amounts at a rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

7. TURNAROUND TIME AND RUSH ORDERS

7.1 Standard Turnaround Time

Our standard turnaround time for order production varies based on order complexity, size, and current production schedule. Estimated turnaround times will be provided at the time of order confirmation.

7.2 Rush Orders

Rush order services are available for an additional fee. Rush order turnaround times and associated fees will be communicated at the time of order placement. Rush orders are subject to availability and production capacity.

7.3 No Guarantee of Delivery Date

While we make every effort to meet estimated production and delivery dates, turnaround times are estimates only and not guarantees. Once your order is shipped, we are not liable for shipping carrier delays or delivery delays outside of our control. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to shipping carrier delays, natural disasters, labor disputes, or material shortages.

7.4 Production Start Date

Production time begins once all of the following have been satisfied:

Final design approval has been received from the Customer;
Payment in full has been received (unless we agree otherwise in writing);
All necessary order details have been confirmed.

8. SHIPPING AND DELIVERY

8.1 Free Shipping Policy

We offer free shipping within the United States on all orders. Free shipping applies to standard ground delivery methods only.

8.2 Shipping Carriers

We use reputable third-party shipping carriers to deliver products. Once products are delivered to the carrier, the carrier assumes responsibility for delivery.

8.3 Risk of Loss

Risk of loss and title for products pass to you upon our delivery to the shipping carrier.

8.4 Shipping Delays

We are not responsible for shipping delays caused by the shipping carrier, weather conditions, customs processing (for international shipments, if applicable), or other circumstances beyond our control.

8.5 Incorrect Shipping Information

You are responsible for providing accurate shipping information. We are not responsible for non-delivery or delayed delivery resulting from incorrect or incomplete shipping addresses provided by you.

8.6 International Shipping

If international shipping is available, it may be subject to additional fees, customs duties, and taxes, which are the sole responsibility of the Customer. International shipping times may vary.

9. DESIGN APPROVAL AND PROOFS

9.1 Proof Approval Required

For most orders, we will provide a digital proof or mockup of your design prior to production. You are responsible for carefully reviewing and approving the proof.

9.2 Customer Responsibility

By approving a proof, you acknowledge that:

The design, colors, text, spelling, and placement are correct;
You have reviewed the proof for accuracy;
You accept responsibility for any errors not identified prior to approval.

9.3 Changes After Approval

Once a proof is approved and production has begun, changes cannot be accommodated. Any requested changes after production has started may result in additional fees and delays.

9.4 Production Without Approval

If you fail to respond to proof approval requests within five (5) business days, we may proceed with production based on the last submitted proof, or we may cancel your order.

10. PRODUCT QUALITY AND COLORS

10.1 Quality Standards

We are committed to providing high-quality custom apparel and use high-quality products. All products are inspected for quality before shipment.

10.2 Color Variations

Colors displayed on your computer screen may not accurately represent actual ink or thread colors due to variations in monitor settings and digital color reproduction. We make every reasonable effort to match colors as closely as possible, but we cannot guarantee exact color matching.

10.3 Minor Variations

Minor variations in screen printing color or placement, print placement, color, and sizing are inherent in the custom printing process and do not constitute defects.

11. RETURNS, REFUNDS, AND CANCELLATIONS

11.1 Custom Products - No Returns

Because all of our products are custom-made to your specifications, we do not accept returns or offer refunds for custom-printed items or other custom apparel orders except as expressly provided in these Terms (for example, a manufacturing defect).

11.2 Defective Products

If you receive products that are materially defective due to our manufacturing error (such as incorrect printing, misprints, or defective garments), you must notify us within seven (7) days of receipt. We will require photographic evidence of the defect. If we determine that a manufacturing error occurred, we will, at our sole discretion:

Reprint or replace the defective products at no additional charge; or
Issue a refund or credit for the defective portion of the order.

11.3 Conditions for Defect Claims

Defect claims will not be accepted for:

Errors present in the approved proof;
Color variations within industry-standard tolerances;
Minor placement variations;
Damage caused by improper care or washing;
Normal wear and tear;
Products that have been worn, washed, altered, or used.

11.4 Order Cancellations

You may cancel your order before production begins for a full refund, minus any non-refundable design or setup fees. Once production has begun, orders cannot be canceled, and no refunds will be issued.

11.5 Company's Right to Cancel

We reserve the right to cancel any order at any time for any reason, including but not limited to suspected intellectual property infringement, fraudulent activity, or inability to fulfill the order. If we cancel your order, we will provide a full refund of any amounts paid.

12. LIMITATION OF LIABILITY

12.1 Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

12.2 Exclusion of Consequential Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.3 Event-Based Orders

For orders placed for specific events (such as sporting events, conferences, church events, summer camps, or other time-sensitive occasions), we strongly recommend placing orders well in advance. While we will make every reasonable effort to meet your deadlines, we are not liable for any damages, losses, or expenses incurred if products are not delivered in time for your event due to production delays, shipping delays, or other circumstances.

13. GARMENT CARE AND MAINTENANCE

To ensure the longevity of your custom apparel:

Wash garments inside out in cold water;
Use mild detergent;
Avoid bleach and harsh chemicals;
Tumble dry on low heat or hang dry;
Do not iron directly on printed or embroidered areas.

Failure to follow proper care instructions may result in fading, cracking, or damage to the custom design. We are not responsible for damage caused by improper care.

14. WEBSITE USE AND CONTENT

14.1 License to Use Website

We grant you a limited, non-exclusive, non-transferable license to access and use our Website for the purpose of browsing and placing orders.

14.2 Prohibited Conduct

You agree not to:

Use the Website for any unlawful purpose;
Attempt to gain unauthorized access to any portion of the Website or any systems or networks connected to the Website;
Interfere with or disrupt the operation of the Website;
Use any automated system to access the Website without our express written permission;

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
